1. Agreement to Terms

By accessing and using the Demix Transport Inc. mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.

2. Eligibility & Account Security

You must be an active Demix Transport Inc. driver or contractor, aged 18 or older. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.

3. Use License

We grant you a limited, non-transferable, revocable license to install and use one copy of the App on a device you own or control solely for your work with Demix Transport Inc.. This is a license, not a sale.

4. Driver Responsibilities

As a driver using our application, you agree to:

• Maintain accurate location updates
• Respond to dispatcher communications in a timely manner
• Keep your account information secure
• Comply with all applicable transportation laws and regulations

5. App Usage

The App is provided for use by authorized drivers of Demix Transport Inc.. You agree to use the App only for its intended purposes, which include:

• Status and location updates
• Communication with dispatchers
• Accessing delivery and route information
• Other functions related to your employment with Demix Transport Inc.

6. Updates, Suspension & Termination

We may modify, disable, or require you to install updates to the App at any time. We may suspend or terminate your access without notice for security reasons, breach of these Terms, or when your employment or contract ends.

7. Disclaimer

The App and its materials are provided on an "as is" basis. Demix Transport Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitations

In no event shall Demix Transport Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if Demix Transport Inc. or an authorized representative has been notified of the possibility of such damage. Our total liability shall not exceed USD 100.

9. Indemnification

You agree to indemnify and hold Demix Transport Inc., its officers, directors, and employees harmless from any claim or demand arising out of your misuse of the App or violation of these Terms.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, U.S.A., without regard to conflict-of-law rules. Exclusive jurisdiction lies in the state or federal courts located in Chicago, Illinois.

11. Changes to Terms

We may revise these Terms from time to time. We will post any adjustments to the Terms on this web page, and the revised version will be effective when it is posted.

12. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Failure to enforce a provision is not a waiver of our right to enforce it later.
